General Terms and Conditions for Bloggers

These Terms and Conditions (the "Terms") are in addition to the General Terms of Use, applied to the website users and located at https://www.joom.com, or/and any other websites owned or operated by Joom, or any sections of those (hereinafter collectively referred to as the "Website"), the Joom mobile application (the"Application", together with the Website referred to as the "Site"), the operation of which is provided by SIA Joom ("Joom"), apply to Users who have a blogger status in the Application (hereinafter referred to as the "Affiliate Blogger", or the "Blogger", as described in these Terms below). These Terms contain the terms and conditions defining the process of granting a Blogger status to a User and the use of additional functions of the Application by Bloggers ("Functions for Bloggers"). By using any of the Functions for Bloggers, as defined below in these Terms, the Blogger accepts the Terms and agrees to comply with all the terms set out below. All other matters not directly affected by these Terms are subject to the General Terms of Use, which apply to the Blogger as a Joom User.

Joom has the right to change these Terms at any time and in its sole discretion. Any changes come into force and apply to Blogger from the moment the new version of the Terms is published on Website www.joom.com.

# 1. Affiliate Blogger

An Affiliate Blogger is a registered User who has been granted a Blogger status by Joom and who can be granted access to additional Functions for Bloggers if the User meets the criteria specified in Section 2 of these Terms. The Blogger status can be assigned to the User by Joom at any time and at Joom's sole discretion, with the User's activity and the history of orders on Site taken into account. Having received the Blogger status, the Blogger can either use the additional functionality provided to the Blogger, or continue to use the Site as a User. Joom reserves the right to change the functionality provided to the Blogger at any time and whenever required at Joom's discretion.

From the moment of receiving the Blogger status, the Blogger authorises Joom to use his/her account by offering it to other Users to subscribe to it, and prioritise placing the Blogger’s account in "Reviews"section of the Application, in order to increase the Blogger's subscriber base. If, for any reason, the User does not agree with the Blogger status granted to him and does not give Joom permission to promote the Blogger’s account as described in this section above, the Blogger must immediately notify Joom of this by sending an email to social_support@joom.com.

# 2. Blogger Exchange Market

When the Blogger’s subscriber base reaches 5,000 unique subscribers from the number of Users, the Blogger, by Joom's decision, may be given access to additional features of the Site - the Blogger Exchange Market (hereinafter referred to as the "Market").

The Bloggers Exchange Market is a section of the Application which contains a list of items, offered by the Sellers selling their products on Site (the "Sellers"), to be ordered by Bloggers. The Blogger can select any product available on the Blogger Exchange Market and apply to order the product. As soon as the Blogger's application is approved by the Seller, the Blogger can order the item by paying the nominal price indicated on Market. By placing an order, the Blogger assures that he/she will prepare and publish a review of the ordered product in "Reviews" section of the Application (the "Blogger Review", or the "Review").

Each product offered by the Sellers on the Blogger Exchange Market will be displayed in one of the following subsections, depending on the processing stage of the Blogger's application:

1."New": all products offered by the Sellers are displayed in the "New" section of the Blogger Exchange Market.
2."Awaiting confirmation": the Blogger's application is pending with the Seller. The Seller can, at his/her discretion, either approve or reject the application within 14 days from the date of the Blogger's application receipt. If the application is rejected by the Seller, it will automatically be moved to the "Archive" (as defined below).
3."Awaiting order": the Blogger's application is approved by the Seller, and the product is available for ordering. From the moment when the application gets approved by the Seller, the Blogger has 2 days to order the product. If the approved product is not ordered within 2 days, the Blogger's application and the Seller's approval will automatically be cancelled, and it will be impossible to re-order the same product by the same Blogger.
4."Awaiting delivery": the ordered product has been sent by the Seller and is in the process of being delivered to the Blogger.
5."Awaiting Review": the product has been delivered to the country of destination (i.e. the country from which the Blogger ordered the product). Starting from the moment when the status of the product changes from "Awaiting delivery" to "Awaiting Review", the Blogger is obliged to publish a Review of the product within 20 days.
6."Completed": the "Completed" section will display all products’ Reviews which have been successfully published by the Blogger.
7."Archive": Blogger's applications which were rejected or were not approved by the Seller within 14 days, as well as the products, Reviews of which were not published by the Blogger within the time period specified in these Terms, will automatically be moved to the "Archive" section.

After 20 days allowed for the publication of the Review of a product with the "Awaiting Review" status, the Blogger will receive a notification about the missed publication deadline, and the product’s status will automatically change from "Awaiting Review" to "Deadline missed". If the 20-day-period deadline is missed for 5 ordered products, the Blogger's access to the Blogger Exchange Market will automatically be blocked so as to be irrecoverable.

The maximum number of applications, orders and/or Reviews prepared by the Blogger at any one time is 100. If the number of current applications, orders or products awaiting reviews reaches the specified maximum value, the access to the Blogger Exchange Market will temporarily be blocked. In this case, in order to get access to the Market, the Blogger must either cancel any of his/her applications, or publish a Review of already received products, so that the total number of the products with any of the above-mentioned statuses becomes less than 100. In case of the application cancellation made by the Blogger, the Blogger's rating will drop.

# 3. Requirements for the Blogger Review

To be published in the "Reviews" section, the Review must meet the following requirements:

1. The Review must include at least 3 different photographs of the ordered product from 3 different angles. The photographs must be of good quality, they must be taken in daylight or with the use of professional lighting equipment. The product in the photographs must be unpacked, and if the product is a piece of clothing, this item must be worn by the Blogger or another model;
2. The Review and attached photographs must not contain any inappropriate content, including but not limited to obscene, sexual, pornographic, dangerous or degrading V. 1.1 as of 09.07.2021 3 content, offensive language. In addition, the Review must not mislead Users or contain deliberately false characteristics of the product. Joom reserves the right, in its sole discretion, to determine if the Review and/or any attachment to it is inappropriate in content and to decline the publication of such Review.

If the Blogger Review does not meet any of the above-mentioned requirements or cannot be published for any other reason, which Joom will deem justified, Joom moderators will notify the Blogger of this. Upon receipt of such notice, the Blogger must make changes to the Review, otherwise such Review will not be published.

If the Review contains any inappropriate content, the Blogger status will be revoked, and access to the Market will be blocked. Joom's decision to revoke the Blogger status and block the access to the Market is non-appealable and can only be made at Joom's sole discretion.

By publishing the Review and any attachments to it (including but not limited to any intellectual property: images, text, audio, video) (also referred to as the "Content"), the Blogger grants Joom, for the entire term of protection of the relevant Content, a non-exclusive, royalty-free, worldwide license with the right to sublicense and/or transfer such license to third parties for storage, use, copying, distribution, modification, public performance or display, translation and creation of derivative works based on the Blogger's Content. If any of the Blogger's Content contains personal data, then by uploading such Content, the Blogger gives his/her consent to subsequent use and processing of such personal data with the purpose of publishing the Blogger's Content and/or promoting products related to such Content. More detailed information on the methods of processing the Users' personal data and the rights associated with such processing can be found in the Joom Privacy Policy.

# 4. Blogger's social networks

By accepting the Terms, the Blogger sends Joom an email with web addresses of the social media accounts administered by him/her: Instagram (www.instagram.com), Twitter (www.twitter.com), YouTube (www.youtube.com), TikTok (www.TikTok.com).

The Blogger grants Joom a non-exclusive license under the terms of section 3 to any Content posted by the Blogger on the Blogger’s social media networks which the Blogger has communicated to Joom.

The Blogger grants Joom a non-exclusive license under the terms of section 3 to any Content sent by the Joom Blogger via email, as well as links to the Content posted by the Blogger in a cloud storage service, sent via email.

# 5. Bonus points

Once published, the Blogger's Review will be displayed in the "Reviews" section of the Application. If a User orders the product, the Review of which has been prepared by the Blogger, following the link to the Review posted by the Blogger on any resource outside the Application, or by the link to the product in the Review published in the "Reviews" section of the Application, the Blogger's account in the Application is credited with bonus points in the amount of 10% of the value of the product.

Bonus points are credited only after the product is sent to the User by the Seller. If, for any reason, the product is not sent to the User, or if the User, for any reason, cancels the order before the product is shipped by the Seller, bonus points are not credited.
